These Terms of Use (“ToU”) govern your access to and use of the Website, the purchase of the CheckGeo GPS tracker device, and any related services provided by the Company (collectively, “Services”). The Privacy Policy, Cookie Policy, and Refund Policy are integral parts of these Terms of Use.

1 Definitions

CheckGeo GPS Tracker means the physical 4G LTE GPS tracking device sold by Frequency First Solutions LLC through CheckGeo.com.

Companion App means any mobile or web application provided by us to operate the CheckGeo GPS Tracker.

Target Device means the person, pet, or asset to which the CheckGeo GPS Tracker is attached for the purposes of tracking.

Payment Information means the full name, credit/debit card number, CVV, card expiry date, and any other information required to process payment.

2 General Provisions

• You must be at least 18 years of age, or the legal age of adulthood in your country, to purchase from CheckGeo.com.
• You are solely responsible for all activity conducted through your account and for ensuring your use of the CheckGeo GPS Tracker complies with all applicable laws and regulations in your jurisdiction.
• You must not share, transfer, or permit any third party to access your account or credentials.
• You must notify us immediately of any unauthorised use of your account or any suspected compromise of your password.
• We reserve the right to modify, suspend, or terminate the Website or Services, or refuse access to any user, at any time and for any reason without prior notice.

3 The CheckGeo GPS Tracker

CheckGeo.com sells a physical 4G LTE GPS tracking device. Features include real-time GPS location tracking, geofence alerts, route playback, and compatibility with iOS and Android via the Companion App. Use of the Companion App and cellular tracking features may require a separate data or service plan provided by a third-party carrier. We are not responsible for any third-party carrier fees, service interruptions, or coverage limitations.

4 Permitted and Prohibited Use

The CheckGeo GPS Tracker is designed exclusively for lawful use. Tracking is only permitted for:

• Your own vehicle, belongings, or assets;
• Pets;
• Your minor children, where you are the parent or legal guardian and such monitoring is lawful in your jurisdiction;
• Any adult individual who has given their full, explicit, and informed consent to being tracked.

Tracking any individual without their full knowledge and explicit consent is illegal and strictly prohibited. Frequency First Solutions LLC accepts no liability for any misuse of the product. If we become aware of unlawful use, we reserve the right to terminate account access and report the matter to the appropriate authorities.

5 Purchase and Payment

• All orders are subject to availability and acceptance by us.
• Prices are displayed in USD and include all applicable taxes unless otherwise stated. We reserve the right to change pricing at any time without prior notice. The price applicable to your order is the price displayed at the time of checkout.
• Payment is processed securely via our payment processor. We do not store any card or banking data.
• You will receive an order confirmation by email once your payment has been successfully processed.

6 Shipping and Delivery

We offer free standard shipping on all orders. Estimated delivery times are displayed at checkout and are indicative only. We are not liable for delays caused by the shipping carrier, customs, or circumstances beyond our reasonable control. Risk of loss and title for products passes to you upon delivery to the shipping carrier.

7 Refund and Return Policy

We offer a 365-day money-back guarantee on all CheckGeo GPS Tracker purchases. If you are not satisfied for any reason within 365 days of your purchase date, contact us at support@checkgeo.com for a full refund. You are not required to return the device to receive your refund. Full terms are set out in our Refund Policy, which forms part of these Terms of Use.

8 Product Warranty

The CheckGeo GPS Tracker comes with a 1-year limited hardware warranty against defects in materials and workmanship under normal use. This warranty does not cover damage caused by accident, misuse, unauthorised modification, or normal wear and tear. To make a warranty claim, contact support@checkgeo.com with your order details. Our 365-day money-back guarantee operates independently of and in addition to this warranty.

9 Intellectual Property

All intellectual property rights in the Website, Companion App, branding, and content belong to and are vested in Frequency First Solutions LLC or its licensors, and are protected by applicable copyright, trademark, and international intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to use the Companion App solely in connection with your CheckGeo GPS Tracker and for personal, non-commercial purposes. You may not reverse engineer, decompile, copy, or distribute the Companion App or any part of the Website without our prior written consent.

10 Disclaimer of Warranties and Limitation of Liability

THE WEBSITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FREQUENCY FIRST SOLUTIONS LLC, ITS AFFILIATES, LICENSORS, AND BUSINESS PARTNERS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR PURCHASE OR USE OF THE PRODUCT OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF $50 OR THE AMOUNT YOU PAID TO US FOR THE PRODUCT GIVING RISE TO THE CLAIM.

We are not responsible for any unlawful or improper use of the CheckGeo GPS Tracker. The product is intended for lawful tracking purposes only and must not be used in violation of the rights, freedoms, or interests of any third party.

11 Indemnification

You agree to indemnify, defend, and hold harmless Frequency First Solutions LLC and its affiliates from and against any and all claims, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to your purchase or use of the product, or any breach by you of these Terms of Use.

12 Modifications to Terms

We may revise these Terms of Use at any time. Updated versions will be posted on the Website with a revised effective date. Your continued use of the Website or purchase of products after any changes constitutes your acceptance of the updated Terms.

13 Assignment

We may assign these Terms of Use, in whole or in part, to any person or entity at any time without your consent. You may not assign your rights or obligations under these Terms without our prior written consent.

14 Severability

If any provision of these Terms of Use is found to be invalid or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect.

15 Governing Law and Dispute Resolution

These Terms of Use are governed by and construed in accordance with the laws of the State of Delaware, United States. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the State of Delaware.

The original and legally binding version of these Terms of Use is written in English. Any translations are for convenience only. In the event of any discrepancy, the English version prevails.
